The Department of Justice just issued a statement from President Obama stating that they will no longer litigate suits challenging the Defense of Marriage Act on the grounds that they believe Section 3 of the Act limiting marriage to heterosexual couples is unconstitutional. Namely, they concluded that the court should consider sexual orientation a suspect class and any laws abridging LGB rights should be considered under heightened scrutiny. Furthermore, they concluded that, while there may be "professionally responsible" arguments supporting the law, there are none the that the DoJ and the Attorney General consider reasonable.
Unbelievable! Or, at the very least, unexpected!
